CET Standard Warranty Warranty: Material and Workmanship Warranty - For a period of one year from date of shipment, SELLER warrants that the merchandise manufactured by SELLER will be free from defects in both material and workmanship. For all components, parts, machinery and equipment not manufactured by the SELLER, SELLER will pass on and assign to BUYER all warranties or guarantees of said components, parts, machinery, and equipment of manufacture other than it own that it sells in connection with setup and the use of its machinery and equipment. Seller shall not be deemed to modify or extend any warranty or guarantee of any item not manufactured by it. Remedies - SELLER'S sole obligation under the material and workmanship warranty shall be to repair, or at its option, to replace, free of charge, any part of its product shown to the satisfaction of the SELLER to be defective, unless SELLER notifies BUYER that SELLER desires BUYER to return the product with a corresponding repayment of so much of the purchase price as had been actually received by SELLER. Replacement warranty parts will be shipped F.O.B. point of origin upon placement of a valid purchase order by BUYER and if SELLER finds that a breach of warranty has occurred, proper credit will be given to the BUYER. BUYER must return defective part from BUYER within 30 days after BUYER receives replacement part. Field service will be billed BUYER at the then prevailing per diem rate plus expenses by SELLER. BUYER'S Obligations - Warranty claims must be in writing. A warranty claim will not be allowed unless the equipment, machinery, or parts have been properly erected, installed, used or maintained and have not been subjected to damage, misuse or abuse in shipping, handling, erection, installing or operation. A warranty claim will not be allowed if any of the additions, modifications, or repairs are made to SELLER'S equipment, machinery or parts other than by the SELLER. BUYER in order to avail itself of remedies listed herein for non-conforming goods must notify SELLER in writing of non-conformity in the goods, material, workmanship or performance, within one week of discovery anytime within the warranty period. SELLER shall not be responsible for the performance of its equipment used by BUYER if its operations differs in any essential respect from the material or equipment identified by BUYER and on which any specifications are based. No payment or allowance will be made for repairs or alterations in the machinery or equipment unless SELLER'S prior written approval is obtained.
